New Jersey Law makes it illegal to possess drug paraphernalia under N.J.S.A. 2C:36-2. This statute defines “drug paraphernalia” as anything that an individual intends to use to ingest or smoke controlled dangerous substances (“CDS”). The statute sets forth a number of items that are capable of being “drug paraphernalia” including pipes, bowls, water pipes and bongs, roach clips, and spoons. An entirely separate statute, N.J.S.A. 2C:36-6, applies where the paraphernalia is a hypodermic needle or syringe.

A violation of either N.J.S.A. 2C:36-2 (“Possession or use of drug paraphernalia”) or N.J.S.A. 2C:36-6 (“Possession or distribution of hypodermic syringe or needle”) is generally a disorderly persons offense. What this means is that you will be exposed to the possibility of being sentenced to up to 6 months in the county jail, fined $1,000 and have your driver’s license suspended for 6 months if you are found guilty of drug paraphernalia possession. If the violation occurred in a car or other motor vehicle and you were operator, you face an enhanced period of suspension of 2 years in accordance with N.J.S.A. 39:4-49.1.
